By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for following reliefs as substantial reliefs: "i) Issue a writ, order or direction in the nature of Mandamus directing the respondent no. 2 to consider the claim of petitioner and release the amount deducted in the head ofN.P.S. and Gratuity, within stipulated period as fixed by this Hon'ble Court. ii) Issue a writ, order or direction in the nature of Mandamus directing the respondent no. 2 to decide the representation/ application submitted before the respondent no. 2 on 20.08.2024 regarding to pay the rest dues amount, within stipulated period as fixed by this Hon'ble Court." It appears from the records that the petitioner has already represented the matter to the respondent no. 2. Learned Standing Counsel submits that he has no objection in the event this petition stands disposed of with a direction to the respondent no. 2 to look into and consider the grievance of the petitioner and pass appropriate order strictly in accordance with law. In view of the above, this petition stands disposed of with a direction that respondent no. 2 shall consider the grievance of the petitioner raised in his representation and decide the same within a period of two months from the date of receipt of certified copy of this order after giving full opportunity of hearing to all the parties who have stakes in the terminal dues of the deceased employee. Needless to add the order to be passed by the competent authority, as directed herein above, shall be reasoned and speaking one.
