The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita, has been filed by the applicant with a prayer to issue a direction to the Sub Divisional Magistrate, Sadar, Basti to comply the order dated 04.11.2023 passed by S.D.M./ opposite party no. 2, in Case No. 11186 of 2023 of 2022 (Ram Naresh Vs. Thakur Prasad and others) under Section 133 of Cr.P.C. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
