1. The petitioners have filed the present petition under Article 226/227 of the Constitution of India with a prayer to issue a writ in the nature of certiorari for quashing of public notices (Annexure P-2) and the Recruitment Notice/Advertisement (Annexure P-1) to the extent of not incorporating of essential qualification of diploma in Civil Engineering for the post of Technical Assistant under MGNREGA Scheme in District Fazilka as the same was contrary to the Rules (Annexure P-3) and other advertisements (Annexure P-4), issued in different Districts of Punjab by the respondents. A further prayer has been made to direct the respondents to incorporate ‘Diploma in Civil Engineering” as an essential qualification for the post of Technical Assistant under the MGNREGA Scheme. 2. Vide order dated 02.04.2022 passed by a Co-ordinate Bench of this Court, the petitioners were allowed to appear in the written test on 03.04.2022, provisionally, subject to the final outcome of the present writ petition. In compliance of the said interim order, the petitioners were allowed to participate in the selection process and they had appeared in the written test, which was held by the respondents on 03.04.2022. Later on, this Court, vide order dated 31.07.2025 had observed that the result of the petitioners may be produced before this Court in a sealed cover and on 03.09.2025, the result was produced in a sealed cover. 4. Today, during the course of hearing, the sealed cover, containing the marks obtained by the petitioners in the written test was opened and it has been found that Paramjeet Singh, petitioner No.3 had obtained 31.05 marks, Gurpreet Singh, petitioner No.1 had obtained 22.125 marks and Monika, petitioner No.2 had obtained 23.25 marks. 5.
Learned State counsel submits that the cut off marks in the written test for Scheduled Caste category were 35, whereas all the petitioners have not been able to secure 35 marks and have not been called for interview in the selection process. 6. In view of the statement made by learned State counsel, it is apparent that the petitioners could not qualify the written examination for the post of Technical Assistant and the pendency of the writ petition is not going to serve any purpose. 7. In view of the above discussion, no further orders are required to be passed by this Court and the petition is, accordingly, dismissed. (N.S.SHEKHAWAT) 04.09.2025
