Heard the parties.
The petitioner has been made accused in connection with M.G.M. P.S. Case No. 131 of 2023, corresponding to Special POCSO Case No.85 of 2023, for the offence registered under Section 376(2)(n) of the Indian Penal Code and Sections 4/6 of POCSO Act, pending in the court of learned Special Judge Exclusive (POCSO) Court, Jamshedpur.
On the pretext of marriage, petitioner is alleged to have established consensual physical relationship with the prosecutrix, who is a major lady. Later on, petitioner refused to marry her.
It appears that the parties were in consensual physical relationship for about one year.
Considering the aforesaid fact, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Special Judge Exclusive (POCSO) Court, Jamshedpur, in connection with M.G.M. P.S. Case No. 131 of 2023, corresponding to Special POCSO Case No.85 of 2023.
