The petitioner alleges that the private respondents have raised unauthorized construction without obtaining sanction from the concerned authority within the jurisdiction of industrial planning area managed and controlled by Haldia Development Authority in respect of which the concerned Panchayat Samiti is competent to sanction a building plan. This Court is informed that sanctioned building plan has been granted in favour of the 9th respondent in respect of the plot in question on 22nd January, 2025 by the Pradhan, Garkamalpur Gram Panchayat, being the 5th respondent herein. Learned counsel for the petitioner submits that the Pradhan is not the authority to grant such sanction for the construction within the jurisdiction of industrial planning 2 area managed and controlled by Haldia Development Authority and the Panchayat Samiti is the competent authority to grant such sanction. In the event the petitioner is aggrieved by grant of sanction in favour of the 9th respondent, he is at liberty to approach the appropriate forum for redressal of his grievance. In view of grant of sanctioned building plan in favour of the 9th respondent herein, nothing further remains to be dealt with in the present application the same is accordingly disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
