Heard the learned counsel for the respective sides.
In this application, the petitioners have prayed for initiating a contempt proceeding for willful and deliberate violation of the order dated 24.08.2023 passed by this Court in W.P.(S) No. 817 of 2022.
The relevant part of the order dated 24.08.2023 passed in W.P.(S) No. 817 of 2022 reads as follows:
“Since the representation of the petitioner no. 1 with respect to providing compassionate appointment to petitioner no. 2 is pending before the respondent no. 2, the respondent no. 2 is directed to dispose of the said representation by also taking into consideration the order passed in W.P.(S) No. 1146 of 2016 within a period of eight weeks from the date of receipt / production of a copy of this
order.”
It has been submitted by Mr. P.K. Mukhopadhyay, the learned counsel for the petitioners that though there was a specific direction passed by this Court to consider the representation of the petitioner no.1 in the light of the order passed in W.P.(S) No. 1146 of 2016 but the opposite parties have rejected the claim of the petitioners and have taken recourse to a separate
order which itself indicates non-compliance of the order dated 24.08.2023 passed in W.P.(S) No. 817 of 2022.
The learned AC to GP-III has submitted that the order dated
04.02.2025 itself contains reasons and is in the teeth of the order passed by the writ Court in W.P.(S) No. 817 of 2022.
On perusal of the reasoned order dated 04.02.2025, it clearly transpires that the order passed in W.P.(S) No. 1146 of 2016 has been taken into consideration by the concerned authority and thereafter the claim of the petitioners for grant of compassionate appointment has been rejected. The reasoned order therefore indicates sufficient compliance of the order dated 24.08.2023 passed in W.P.(S) No. 817 of 2022 and in such circumstances, I am not inclined to proceed further in this contempt application which accordingly stands disposed of with a liberty to the petitioners to challenge the reasoned
order dated 04.02.2025 in an appropriate proceeding.
