Neutral Citation No. - 2025:AHC:77188 Court No. - 77 Case :- TRANSFER APPLICATION (CRIMINAL) No. - 160 of 2025 Applicant :- Satyapal Singh Opposite Party :- State Of U.P. And 4 Others Counsel for Applicant :- Noor Muhammad,Yogesh Kumar Srivastava Counsel for Opposite Party :- G.A.,Niklank Kumar Jain Hon'ble Manoj Bajaj,J. Applicant-Satyapal Singh has filed this petition under Section 447 B.N.S.S., 2023 for transfer of Sessions Trial No. 397 of 2008; titled State vs. Surendra and others, arising out of Case Crime No. 30 of 2008, under Section 302/34 IPC, registered at Police Station Nidholi Kalan, District Etah, pending before the Sessions Judge, Etah to any other court of competent jurisdiction in Uttar Pradesh. When the case is called out, no one has appeared on behalf of the applicant. A perusal of the paper book would show that the Presiding Officer recused from the trial on 24th February, 2025, and the case was kept by Sessions Judge, Etah and fixed the case for recording additional statement of the accused under Section 313 Cr.P.C. It is pleaded that as the statement of the accused under Section 313 Cr.P.C. stood recorded on 11th November, 2022, the additional statement could not have been ordered to be recorded vide order dated 28th February, 2025. If, the applicant-complainant is aggrieved against the order dated 28th February, 2025, he can avail his remedy to challenge the said order, but this order would not be a ground for transfer of the case. The application fails and is hereby dismissed. Order Date :- 12.5.2025 Brijesh Digitally signed by :- BRIJESH KUMAR High Court of Judicature at Allahabad
