THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE MOHAMMAD NAWAZ ORAL ORDER This petition under Section 482 of Cr.P.C. is preferred by the petitioners/accused Nos.1 to 3 praying to quash the entire proceedings pending on the file of the XXXVII Additional Chief Metropolitan Magistrate, Bengaluru City in C.C.No.1722/2021. 2. FIR was registered on a complaint lodged by respondent No.2, wife of petitioner No.1, alleging offences - 3 - NC: 2025:KHC:17920 CRL.P No. 8412 of 2023 Punishable under Section 498-A of IPC and Section 4 of the Dowry Prohibition Act, 1961. Police have completed investigation and filed the charge sheet. 3. I perused the complaint averments. A bare perusal of the same do indicate that there are allegations against these petitioners alleging dowry demand and harassment meted to the complainant and therefore, at this stage it cannot be said that there is no prima-facie case made out. 4. It is submitted by both the learned counsel appearing for the parties that the charges are already framed and the trial is in progress. Recording of evidence of respondent No.2/CW.1 is in progress. 5. Considering that the matter arises out of matrimonial dispute, this Court permitted the parties to appear before the Mediation Centre, Bengaluru, to eke out a possibility of settlement. As per the mediation report, the parties were not able to come to an agreement during mediation. - 4 - NC: 2025:KHC:17920 CRL.P No. 8412 of 2023 6. Since the proceedings are pending before the Trial Court, no observations can be made on the merits of the case, as it may prejudice the case of both parties. 7. Learned counsel appearing for petitioners submits that the complainant is not co-operating for the expeditious disposal of the case and even though no stay was granted in this case, the trial is pending since 25.10.2021 and the trial is proceeding in a slow pace. 8. As per the order sheet of the Trial Court, charges were framed on 25.10.2021. Considering the same, trial court is directed to expedite the trial. Petition is dismissed with the above observation.
