PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A2, seeking regular bail, 'ln Crime No.173 of 2024 of Gopalapatnam - Police Station, Visakhapatnam Commissionerate. 2. A case has been registered against the Petitioner herein and others for the offences punishable under Sections ``=-- Q`._, |_-i=-q=--fl 2 \ 20(b)(ii)(C) and 21(a) read with 8(c) of the Narcotic Drugs and psychotropic substances Act,1985 (for short lthe NDPS Act') and Section 34(a) of the AP Excise Act. 3. Case of the prosecution, in brief, iSthat, On 10.07.2024, at about 10.00 hours, at Main Road, Near Under Ground Railway Bridge, SC Colony, Kothapalem, Gopalapatnam, visakhapatnam, on credible information, the sub-Inspector of police, Gopalapatnam Police Station, along with his staff and mediators, arrested Al to A3 and seized 3 KGs of Weed Oil, 1.55 Kgs of Ganja and 0.5 mg of MDMA from their possession. Al to A3 confessed that they purchased the Same from A4 and A5. The contraband was seized under cove+ Of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5. The quantity of contraband that was seized from the possession of all the accused is 3 KGs of Weed Oil, 1.55 Kgs of Ganja and 0.5 mg of MDMA. Petitioner herein was arrested on 10.07.2024 and`sinCe then he is in jud-lCial remand. Petitioner is languishing in jail for more than 200 days. Statutory period of 180 days has expired. But, the police have not completed investigation nor filed charge sheet in this cr-lme so far. lt is also not known as to whether the police have filed any application a.,-`~.-i| I,A:::,,,,:,,,,hob 3 \ before the jurisdictionaI Court for extension of time for completing the investigation or not. 3 6. In view of the aforesaid facts and Circumstances Of the case, this court is inclined`to grant bail to the petitioner/A2 on the following conditions. i) The petitioner/A2 shall be released on bail on his executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) With two Sureties Of the like Sum each tO the satisfaction of the learned I Additional District and Sessions Judge-Gum-Special Judge for trial of offences under the NDPS Act, Visakhapatnam. ii) on release, the petitioner shall appear before the station House Officer concerned, Once in a Week i.e., On every saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. 7.
