CMP No. 7301 of 2024 in CMP(M) No.687 of 2024 After hearing the parties for some time, parties have arrived at the agreement that AW1 Mohar Singh, Sub Inspector, Police Station Sadar Bilaspur, whose statement was recorded on 18.8.2022, is not to be examined again, but he has to be summoned only for the purpose of production of original record, which is required to be proved/exhibited in the statement of applicant, who is yet to be examined. The documents, which have already been proved on record by AW1 and have not been objected by respondents/non-applicants, are not required to be proved again, though can be referred in statement of applicant as already exhibited documents and other documents which are to be proved on the basis of original to be produced by AW1 Mohar Singh shall be summoned through Incharge Police Station Sadar Bilaspur either in person or through any official working under him and such witness shall only produce the entire original record which may be referred by the applicant in his statement by producing/proving photocopies thereof after comparison with original record in accordance with law. Needless to say the original record to be summoned can be used by applicant as well as respondents for the purpose of examination and cross-examination of applicant. With aforesaid observations, application is allowed and disposed of in aforesaid terms. CMP(M) No. 687 of 2024 Be listed for before the Registrar(Judicial)/Additional Registrar (Judicial) for further proceedings in the light of observations made in CMP No. 7301 of 2024.
