Learned counsel for the petitioner would restricted his submission to the extend that the petitioner has been promoted on the post of Head
2 Master, Primary School, vide order dated 01.05.2025 and she has been posted at Govt. Middle School, Siladehi, Block- Bamhnidih, Dist- Janjgir-Champa. However, she opted at the time of counseling to be posted at Govt. Middle School, Champa, Block- Bamhnidih, Dist- Janjgir-Champa and the post of Head Master, Middle School is lying vacant at Middle School, Champa for which she has already made her representation on 06.05.2025 but the Respondent No. 4 has not decided her representation till date, therefore, the Respondent No. 4 may be directed to take decision on the pending representation dated 06.05.2025 in accordance with law and as per the Clause-12 of Circular dated 15.04.2025.
2. On the other hand, learned State counsel has no objection if such a directing is being made to the Respondent No. 4 to take decision on the pending representation of the petitioner dated 06.05.2025 in accordance with law.
3. Considering the submissions made by learned counsel for the parties and limited prayer made by the petitioner, the present writ petition is
disposed of directing the petitioner to move her fresh representation before the Respondent No. 3 & 4 within 02 weeks from today along with the copy of this order and if such representation is being made by the petitioner, the Respondent No. 3 & 4 is directed to take the decision on the representation made by the petitioner in accordance with law and applicable Rules and Circular governing the filed within further period of 60 from the date of receipt of the copy of the representation in accordance with law on its own merits.
