The prayer of renewal of passport has not been considered on account of implication of petitioner in Case Crime No. 403 of 2007, under Sections 498A, 323, 504, 506 IPC and 3/4 D.P. Act, P.S. Phulpur, District Azamgarh. Learned counsel for the petitioner submits that petitioner is not in a position to return to India or approach the Court concerned for obtaining No Objection Certificate in view of the law laid down by this Court in the case of Pawan Kumar Rajbhar Vs. Union of India & 2 Ors (Writ - C No. 41540 of 2023). Learned counsel for the respondents states that if that be so, the petitioner may approach the concerned embassy and request for issuance of emergency passport, which shall be accorded consideration in order to enable the petitioner to return back to India to obtain necessary No Objection Certificate. In that view of the matter, we dispose of this petition with the observation that in the event petitioner approaches the concerned embassy for issuance of emergency passport in order to return to India, such request shall be dealt with as per the law.
