1. Petitioner has filed this petition for the following reliefs: a) Issue a writ of Mandamus, or any other appropriate writ, order or direction, directing the Respondents to forthwith grant the Petitioner
Wps 7078 of 2025 2 one notional increment as per Financial Order/Circular No.26/2023 dated 03.08.2023 with all consequential benefits, including arrears of retiral benefits and pensionary entitlements; b) Direct the Respondents to decide the Petitioner's representation dated 09.05.2024, within a fixed period and pay the Petitioner all other lawful dues such as one notional increment, travel allowance, medical allowance, and other retiral benefits as per applicable rules; c) Award interest on delayed payment of the retiral benefits at a rate this Hon’ble Court deems just and proper, from the date the payment became due till actual realization: d) Pass such other or further orders as may be deemed just and proper in the facts and circumstances of the case, including costs of this petition.”

Learned counsel for the petitioner would restrict his submission that petitioner is entitled for one notional increment as per Financial Order/Circular No.26/2023 dated 03.08.2023 (Annexure P2), for which he has moved representation on 09.05.2024 but till date, neither his representation has been decided nor any benefit of notional increment has been provided to him. Therefore, the authorities may be directed to consider the pending representation of the petitioner within the stipulated time frame.

Learned counsel for the State would submit that petitioner may be
directed to file fresh representation along with copy of this order, and the authority may decide the said representation as early as possible.

4. Heard learned counsel for the parties, and perused the documents on record.

Considering the limited submission made by learned counsel for the petitioner, and also issue involved in the present petition, petitioner is directed to move a fresh representation before respondent-6 within further two weeks from today, and if such representation is made by the petitioner, the same shall be decided in accordance with law, within further period of two months from the date of receipt of representation on its own merits, after verifying the service record of the petitioner.
