This Criminal Miscellaneous Petition filed for restoration of Criminal Revision No. 188 of 2017, which was dismissed for default on 25.04.2022 passed by this Court.

Learned counsel for the petitioner submitted that due to some unavoidable circumstances learned counsel for the petitioner could not appear before this Court on 25.04.2022. and it is also submitted that the petitioner is seriously ill since 2022 to till date and hence in the interest of justice, this Criminal Revision No.188 of 2017 may be restored.
3. On the other hand, learned State counsel has opposed the prayer and it is submitted that the petitioner has not followed proper steps, however, he should remain vigilant in future.
4. Having heard learned counsel for the both the sides and in view of the averments made in Paragraph no.6,7,8,9 and 10, of Cr.M.P. No.4155 of 2023 the Prayer for restoration of Criminal Revision No.188 of 2017 is allowed.
5. Accordingly Criminal Revision No.188 of 2017 is restored to original file.
6. Thus, this Criminal Miscellaneous Petition No.4155 of 2023 is allowed and stands disposed of
However, the learned counsel for the petitioner should remain vigilant in future.
7. Office is directed to place the Criminal Revision No.188 of 2017 after one week.
