The applicant has preferred this First Bail Application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.171/2025, registered at Police Station- Basna, District Mahasamund (C.G.) for the offence punishable under Sections 20(b) of Narcotic Drugs and Psychotropic Substances Act. (for short ‘NDPS’). 2 2. The prosecution story in brief, is that, on the basis of secret information, the Police of Police Station Basna, District – Mahasamund (C.G.) has recovered 19 Kgs Ganja from illegal possession of the applicant and other co-accused. According the offence has been registered and the applicant has been arrested. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. It is further submitted that the applicant is law student who is pursuing B.A.L.L.B from Kalinga University Raipur. She further submits that the applicant had come to visit Narsingnath Temple Odisha and due to breakdown of the vehicle, he was coming to Basna by asking for lift in a vehicle without his knowledge of what was in the alleged vehicle. She also submits that the charge-sheet has been filed and the applicant is in jail since 26.04.2025 and the applicant has no criminal antecedents. The conclusion of the trial is likely to take some time, therefore, he prays for grant of bail. 4. On the other hand, the learned counsel for the State opposes the bail application and submits that the charge-sheet has been filed. She further submits that quantity of contraband article i.e. 19 kgs of Ganja has been seized from the possession of the applicant and co-accused person. Hence, his bail application is liable to be dismissed. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Taking into consideration the fact that the applicant along with two co-accused persons were arrested with 19 Kgs of Ganja and the charge-sheet has been filed and he has no criminal antecedents, but PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2025.06.28 17:35:19 +0530 3 considering the fact that quantity of contraband article i.e.19 Kgs of Ganja and the applicant happens to be a student goes to show that he is indulge in a such activities, and the applicant has failed to give any explanation for the same and it cannot be said to be a case of false implication, accordingly, the bail application of applicant – Aaditya Meshram involved in Crime No.171/2025, registered at Police Station- Basna, District Mahasamund (C.G.) for the offence punishable under Sections 20(b) of Narcotic Drugs and Psychotropic Substances Act. (for short ‘NDPS’)’, is rejected at this stage. 7. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 8.
