CORAM: HON'BLE MR JUSTICE N S SANJAY GOWDA ORAL ORDER The petitioner has filed this writ petition seeking to issuance of a direction to the respondents to consider the representation dated 24.02.2023, wherein, the petitioner is requesting for his unauthorized occupation to be regularized as per form No.53. 2. Learned AGA, on instructions, submits that the Tahasildar, on enquiry, has come to the conclusion that petitioner would be ineligible for consideration of his

application and therefore, it has been forwarded to the Deputy Commissioner and in all probability, the orders will be passed within a period of 2 to 3 weeks. 3. In the light of the above submissions, it is clear that the case of the petitioner has been considered and the matter is at the stage of passing of the orders on his application.
In that view of the matter, the prayer in this writ petition would not survive for consideration. Hence, the writ petition is disposed of. 4. However, it is made clear that in the event the Deputy Commissioner accepts recommendation of the Tahasildar and holds that the petitioner is ineligible, the petitioner would always have the liberty to challenge the said action.
