This criminal miscellaneous petition has been filed under section 528 of B.N.S.S., 2023 by the petitioner with a prayer for modification of the
order dated 12.08.2021, passed by this Court in A.B.A. No. 5258 of 2021.
It is jointly submitted by the learned counsel for the petitioner and the learned counsel for the informant by drawing attention of this Court to Interlocutory Application No. 303 of 2025 that the petitioner was given the privilege of anticipatory bail with the condition that the petitioner be released on bail on depositing Rs.30,000/- by way of demand draft drawn in favour of the informant. It is next submitted that the dispute between the parties is a family dispute and during the pendency of this case, the parties have compromised the matter and the same has been amicably settled after intervention of family members. Hence, it is submitted that the condition of depositing Rs.30,000/- by way of demand drawn in favour of the informant be waived.
Considering the aforesaid facts, the order dated 12.08.2021, passed by this Court in A.B.A. No. 5258 of 2021 is modified by waiving the condition of depositing Rs.30,000/- by way of demand drawn in favour of the informant and the prayer for extension of time for the petitioner to surrender in the court below in terms of the order dated 12.08.2021, passed in A.B.A. No. 5258 of 2021 is allowed. Hence, the petitioner is directed to surrender before the court below “within six weeks from the date of this
order in terms of the order dated 12.08.2021, passed in A.B.A. No. 5258 of 2021”.
The order dated 12.08.2021, passed in A.B.A. No. 5258 of 2021 is modified to the aforesaid extent only.
This criminal miscellaneous petition is disposed of accordingly.
