In Re:- An application for anticipatory bail under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023/under Section 438 of the Code of Criminal Procedure. In connection with NDPS case no. 16 of 2023 arising out of Dalkhola Police Station Case no. 125/2025 dated 21.5.2023 under section 21(b) of the NDPS Act.
In the matter of: Imran Sekh @ Biswas @ Imran Biswas … Petitioner
Ms. Shalini Bairagi Mr. Priyam Kar …for the petitioner. Mr. Ranadeb Sengupta Mr. Prakash Mishra …for the State.
1. Learned counsel appearing on behalf of the petitioner submits that apart from the statement of co-accused, there is no other incriminating material available against the petitioner. Charge-sheet has been submitted.
2. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that there is a statement of a local independent witness who had seen the petitioner hand over a packet to the bus driver from whom the contraband was seized. Additionally, there were calls made between the petitioner and the principal accused.
3. In view of the incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.
