(At Present Confined In District Jail Kekri, Rajasthan). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Anirudh Tyagi Mr. Saurabh Vaishnav For Respondent(s) : Mr. Jitendra Singh Rathore, Addl. GA HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 31/01/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 07/2024 registered at Police Station Sarana, District Kekri for the offence(s) under Sections 8 and 15 of NDPS Act. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. Learned counsel further submits that alleged quantity of contraband articles containing 48.250 kilogram of poppy straw, was recovered from accused-petitioner which is below commercial quantity. There is no criminal antecedents against the petitioner regarding commission of offence under NDPS Act, there is only one case registered against the petitioner filed under Sections 279, 337 and 338 of IPC. Petitioner is behind the bar since 26.11.2024 and the trial of [2025:RJ-JP:4384] (2 of 2) [CRLMB-553/2025] the case will take considerable time. Therefore, the benefit of bail may be granted to the accused-petitioner. Per contra, learned Public Prosecutor opposes the bail application and contended that from the petitioner's vehicle 48.250 kilogram of poppy straw was recovered and petitioner did not claim his vehicle for almost ten months, therefore, considering the above facts bail application of the petitioner deserves to be dismissed. Heard and perused the material available on record. Considering the arguments advanced by counsel for the parties and looking to the fact that petitioner is in custody since 26.11.2024 and trial of the case will take considerable time moreover recovered quantity of poppy straw is below commercial quantity and apart from one case of motor accident there are no criminal antecedents against the petitioner, therefore, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Sujaram S/o Govind, in connection with FIR No.07/2024 registered at Police Station Sarana, District Kekri (Raj.) shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
