M CHALAPATI RAO The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus directing the 3rd respondent police to grant police aid for implementation of the orders made in C.R.P.No. 947 of 2020 dt.27- 08-2020 to protect the petitioners peaceful possession and enjoyment of the land in Sy.No.926-K1 an extent of Ac.8.63 cents of Pedda Harivanam Village of Adoni Mandal, Kurnool District in the interest of justice.” 2. Sri M.Chalapati Rao, learned counsel for the unofficial Respondents would submit that the Petitioner herein has moved an application before the trial Court with the same relief, which is pending consideration before the trial Court. 3. Sri Vattikuti Sreemannarayana, learned counsel for the Petitioner would submit that the Court may pass appropriate orders. 4. Sri V.Farooq, learned Assistant Government Pleader, on written instructions, would submit that, there is no specific direction in the Order passed in C.R.P.No.947 of 2020 and unless there is a direction from the Court, Police cannot provide police protection. 5. In the light of the Orders dated 27.08.2020 in C.R.P.No.947 of 2020 passed by a Coordinate Bench of this Court, setting aside the Order dated 28.02.2020 passed in C.M.A.No.8 of 2019 on the file of the Court of II Additional District Judge, Kurnool, which was preferred against the Order in I.A.No.46 of 2018 in O.S.No.6 of 2018 and pendency of an application filed by 3 the Petitioner with the same relief before the trial Court, where the firsthand information is available, it is apposite to dispose of the present petition. 6. In that view, the Writ Petition is disposed of giving liberty to the Petitioner to pursue his remedy before the trial Court and the learned trial Judge may look into the issue and take appropriate decision according to law as expeditiously as possible. There shall be no order as to costs.
