The petitioner has been made accused in connection with Chandwa P.S. Case No. 213 of 2023, for the offences registered under Section 376 of the I.P.C., pending in the Court of learned Additional Chief Judicial Magistrate, Latehar. 3. On 28.10.2023, at about 04:00 a.m., the informant had gone to attend the call of nature when the petitioner intercepted her and raped her. 4. Mr. Abhay Kr Chaturvedy, learned counsel appearing on behalf of the petitioner has submitted that the entire occurrence appears to be exaggerated because the occurrence had taken place at 04:00 a.m. It was further submitted that none of the witnesses have supported the prosecution case. It was further submitted that nobody reached the place of occurrence except the husband of the victim. It was finally submitted that the petitioner has been falsely implicated in this case because of pending civil case between the parties. 5. Considering the fact that there is allegation that the petitioner has raped the prosecutrix, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected.
