In this petition filed under Section 528 of BNSS, 2023, the petitioners seek a direction for early disposal of its application for maintenance under Section 125 of Cr.P.C. in MJC (Criminal ) No. 82/2023 (Mrs. Rachna Singh & another Vs. Facts of the case are that the marriage between the Petitioner No. 1 and the Respondent (her husband) was solemnized on 10.12.2017, in Muzaffarpur, Bihar. Before the marriage, the Respondent and his family demanded dowry, which the Petitioner's family fulfilled by providing cash and bank transfers amounting to Rs.25,00,000 and a Honda City car, besides bearing the entire marriage expenses in a 5-star hotel. Despite financial strain, the Petitioner's family met these demands. The marriage was tumultuous from the start, with the Respondent and his family making illegitimate demands for gifts and expenses during the wedding ceremonies. After the marriage, the Petitioner No. 1 faced constant harassment, coercion, and mental cruelty, including demands for money, jewelry, and valuables from her parents. Her life in the matrimonial house was miserable, and she was denied basic amenities and a dignified life. Due to unbearable physical and mental distress, she moved to Ahmedabad with the Respondent but continued to face harassment. Eventually, on 16.08.2021, she was thrown out of her matrimonial house and left without basic amenities. The Petitioner No. 1 has filed an application under Section 125 of the CrPC in MJC (Criminal) No. 82/2023 pending before the learned Principal Judge, Family Court, Katghora, District- Korba (C.G.).
3. The learned counsel for the Petitioner submits that the Petitioners have filed an application under Section 125 of the
3 CrPC seeking maintenance, along with an application for ad- interim maintenance, which remains pending before the Principal Judge, Family Court, Katghora. Despite the Respondent being ex-parte, the application has not been decided to date, and the proceedings are progressing at a slow pace over the past two years. Therefore, the counsel prays for a direction to the Principal Judge, Family Court, Katghora, District Korba, to expeditiously decide the said application.
4. I have heard learned Counsel appearing for the Petitioners and perused the documents annexed with the petition including the
order sheets of the Trial Court.
5. In view of the limited prayer made in this petition, without commenting on the merits of the case, this Court directs the Principal Judge, Family Court, Katghora, District Korba, to expeditiously decide the application under Section 125 of the CrPC in MJC (Criminal) No. 82/2023.
