In compliance to the order of even date, learned counsel for the petitioner has placed on record a receipt dated 16.06.2026, regarding the deposit of ₹45,000/-, which is 7.5% of the cheque amount of ₹6,00,000/-, issued by the Member Secretary, H.P. Legal Services Authority, Kasumpti, Shimla, District Shimla, H.P. 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes. 2 2. Learned counsel for the respondent under instructions, submits that the complainant/respondent does not want to proceed further with the complaint in view of the compromise effected between the parties. 3. In view of above, present revision petition is allowed and the judgment passed by learned Additional Sessions Judge, Rampur, Bushehar, District Shimla, District Shimla, in Criminal Appeal No. 934 of 2025, decided on 16.09.2025 (learned Appellate Court) affirming the judgment of conviction and order of sentence dated 17.05.2025, passed by Additional Chief Judicial Magistrate, Rampur Bushehar, District Shimla, H.P. (learned Trial Court) passed in Criminal Complaint under Section 138 of Negotiable Instruments Act (N.I.Act) bearing registration No. 264 of 2021. are ordered to be set aside and the complaint is dismissed as not pressed. 4. Learned counsel for the petitioner submits that no amount has been deposited before the learned Courts below or before this Court, hence, no order is required to be passed regarding the disbursal of the amount. 3 5. The petitioner is stated to be in judicial custody and he is presently lodged in Model Central Jail, Kanda, Shimla, District Shimla, H.P. He is ordered to be released forthwith, if not required in any other case. Release warrants be prepared accordingly and the same be sent to the Jail Superintendent, Model Central Jail Kanda, District Shimla, H.P. and learned Trial Court through FASTER forthwith for necessary compliance. 6.
