Petitioner has been made an accused in connection with Chhattarpur P.S. Case No. 166/2024, for the offences registered under Sections 111(2)(b)(4), 310(4) & (5) of the B.N.S., 2023 and Section 25(1-B)a, 25(6)/35 of the Arms Act, pending in the Court of Sri P.N. Upadhyay, learned J.M.F.C., Palamau, Daltonganj. On 21.09.2024, at about 09:00 p.m., Chhattarpur Police, on the basis of confidential information that unknown criminals had assembled at village Madanpur and were making preparation for committing dacoity, raided the place of occurrence. The petitioner alongwith the co-accused persons were apprehended at the place of occurrence. It was submitted that one loaded country made pistol was recovered from the possession of the petitioner. It was further submitted that the petitioner is in custody since 22.09.2024. It appears that similarly situated co-accused has been granted bail by this court earlier. Learned A.P.P. has opposed the prayer for bail and submitted that a loaded country made pistol was recovered from the possession of the petitioner. Regard being had to the facts and circumstance of the case, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of Sri P.N.
