Neutral Citation No. ( 2025:JHHC:10620 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI ABA No. 1504 of 2025 1. Sanjar Hussain 2. Abdul Salam ... Petitioners Versus Central Bureau of Investigation …Opposite Party --- CORAM: HON’BLE MR. JUSTICE RONGON MUKHOPADHYAY For the Petitioners : Mr. Nilesh Kumar, Advocate For the Opp. Party : Mr. Prashant Pallav, Spl.P.P., CBI --- 03/07.04.2025 Heard Mr. Nilesh Kumar, the learned counsel for the petitioners and Mr. Prashant Pallav, the learned Spl.P.P. appearing on behalf of the CBI. The petitioners apprehend their arrest in connection with RC Case No.66(S)/2017 EOWR. It has been submitted by Mr. Nilesh Kumar, the learned counsel appearing for the petitioners that the main allegation of floating the trust is attributed to Maujiv Khan who has been arrayed as A-4 in the charge-sheet submitted by the CBI. It has further been submitted that the petitioners are said to be the mere accomplices of Maujiv Khan. It has been submitted that charge-sheet has been submitted by the CBI and therefore, in such circumstances, the petitioners deserve to be granted anticipatory bail. Mr. Prashant Pallav, the learned counsel appearing for the CBI has opposed the prayer for anticipatory bail of the petitioners and has referred to various paragraphs of the charge-sheet to impress upon the Court that the petitioners were active associates of the main accused Maujiv Khan in collecting deposits from the market and thereafter duping the investors. It appears from the charge-sheet that Maujiv Khan had opened a trust in the name of M/s Dream People of Life Education and Charitable Trust with the assistance and support of the petitioners and the agents of the said trust had convinced the depositors to deposit in the scheme of the said trust and consequent to the same the office was closed and no trace could be found of the present petitioners as well as the main accused Maujiv Khan. -2- It appears from perusal of the charge-sheet that it is Maujiv Khan who was instrumental in opening the trust though it seems that the petitioners were merely the associates of the said accused person. Moreover, charge-sheet has been submitted on completion of investigation. On consideration of the aforesaid facts, the petitioners are directed to surrender before the learned trial court within four weeks from today and on such surrender, they shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned AJC-XVIII cum Special Judge (CBI), Ranchi in connection with RC Case No.66(S)/2017 EOWR, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023. This application stands allowed. (RONGON MUKHOPADHYAY, J.) S.B.
