GP FOR REVENUE 3 THE HONOURABLE SMT JUSTICE KIRANMAYEE MANDAVA WRIT PETITION NO: 22632 OF 2025 The Court made the following order: The writ petition is filed challenging the inaction of the 3rd respondent in not receiving the documents submitted by the petitioner, which were filed pursuant to the proceedings initiated by the 5th respondent under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. 2. Heard Sri Sriman, learned counsel for the petitioner and learned Assistant Government Pleader for Women Development and Child Welfare appearing for the respondent Nos.1 to 4. 3. It is contended that, pursuant to the complaint filed by the 5th respondent, the 3rd respondent issued a notice to the petitioner, directing the petitioner to appear in person before the Tribunal on 13.08.2025 at 4:00 PM at the Sub-Collector's Office, Rajamahendravaram. However, the said notice was received by the petitioner only on 14.08.2025, i.e., after the scheduled date fixed for his appearance. Upon receipt of the notice, the petitioner approached the 3rd respondent, sought his permission to submit the documents in support of his contentions. However, the said documents were not received by the 3rd respondent. Aggrieved by the same, the petitioner has approached the Court by way of the present writ petition. 4 4. Learned Assistant Government Pleader for Women Development and Child Welfare seeks time to get instructions. Thus, a request made for an adjournment. 5. However, learned counsel for the petitioner would submit that, in the meantime, there is every likelihood that the 3rd respondent may pass orders without hearing the petitioner. 6. Having regard to the contentions advanced, this Court deems it appropriate to dispose of the writ petition with a direction to the 3rd respondent to provide sufficient opportunity to the petitioner to submit his case and allow the petitioner to submit all relevant documents in support of his contentions. After providing such an opportunity, the 3rd respondent shall pass appropriate orders on the 5th respondent’s application, in accordance with law. 7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
