East Godavari district. ...RESPONDENT Counsel for the Petitioner: 1.P L NARASIMHA RAO Counsel for the Respondent: 1. 2 The Court made the following ORDER: The present Civil Revision Petition has been preferred under Article 227 ( of the Constitution of India, aggrieved by the non-disposal of I.A.No.434 of 2024 in A.S.No.52 of 2019 on the file of the Court of II Additional District Judge, East Godavari District at Amalapuram. , 2) Heard the learned counsel for the petitioner. The matter is being disposed of without going into the merits of the Court, therefore, notice to the respondent is deemed not necessary. 3) The petitioner, who is the defendant in O.S.No.122 of 2014 on the file of the Senior Civil Judge, Razole; filed the said appeal aggrieved by the Judgment and Decree dated 19.07.2018 passed by the learned Senior Civil Judge, Razole. Learned counsel submits that seeking stay of all further proceedings pursuant to the said judgment and decree, the petitioner filed I I.A.No.434 of 2024 before the appellate Court, but the same was not disposed of so far. He submits that taking advantage of the same, the respondent / plaintiff is proceeding with the execution proceedings and in the event if the decree is executed during the pendency of the above mentioned appeal, the petitioner will suffer serious prejudice and irreparable loss. Making the said submissions, seeking stay of all further proceedings in E.P.No.13 of 2022, the learned counsel seeks a direction to the learned Appellate Court to dispose of the I.A. referred to above as expeditiously as possible. 3 4)‘ Considering the submissions made, as seen from the affidavit filed in support of the stay petition, it is discernable that only after initiation of execution proceedings the above referred appeal appears to have been filed. Be that as it may. Nothing is stated in the affidavit as to why I.A. adjourned from time to time, much less by filing the docket is being proceedings. Be that as it may. When an appeal IS preferred against the judgment and decree and an application seeking-stay was made, the Appellate Court is required to pass appropriate orders in accordance with law. In the present case, even though the stay application appears to have been moved subsequent to initiation of E.P. proceedings. Appellate Court is duty bound to dispose of the above mentioned I.A. before passing orders in E.P.No.13 of 2022. It appears that the said E.P. stands posted to 12.09.2025. 5) Therefore, the Civil Revision Petition is disposed of providing that the learned II Additional District Judge, Amalapuram, shall proceed with the hearing of the matter i.e., I.A.No.434 of 2024 on the said date and pass appropriate orders in accordance with law, after giving due opportunity to both sides. ^ 5). The Civil Revision Petition is accordingly disposed of.
