ORAL ORDER This petition is filed by petitioner No.1, who is the husband of respondent No.2-complainant, while petitioner No.2 is the deceased sister of petitioner No.1. The present petition seeks quashing of the proceedings in C.C.No.51561/2015 on the file of the X Additional Chief Metropolitan Magistrate, Bengaluru (for short
“the Trial Court”).
2. In the meanwhile, due to pendency of the present petition, the present matrimonial case between petitioner No.1 and respondent No.2 culminated in settlement before the Mediation Centre and the aforesaid M.C.No.7622/2023 was disposed of in terms of the settlement. As per the terms and conditions of the said settlement both petitioner No.1 and respondent Nos.1 and 2

have unconditionally agreed to get the present proceedings quashed and a joint memo in this regard is filed and signed by the petitioner and respondent Nos.1 and 2.
3. The said joint memo reads as under:
“The petitioner and respondent No.2 herein respectfully submits that, pursuant to settlement arrived before the Family Court in M.C.No.7622/2023 dated 18.06.2024, Decree of Divorce has been granted by the Family Court. In the said settlement both petitioner and Respondent No.2 agreed to withdraw the Criminal Case in C.C.No.51561/2015. In view of the settlement arrived between the parties, Criminal Case which is the subject matter of the above case requires to be quashed otherwise it would be abuse of process of law. Wherefore, the petitioner and respondent No.2 herein respectfully prays this Hon’ble Court may pleased to quash the proceedings in C.C.No.515617/2015 to meet the interest of justice.”
4. In view of the aforesaid facts and circumstances and joint memo filed by petitioner No.1 and respondent Nos.1 and 2, invoking my jurisdiction under Section 482 Cr.P.C., I deem it just and appropriate to quash the instant criminal proceedings.
5. Accordingly, the Criminal Petition is disposed of and all further proceedings in C.C.No.51561/2015 pending before the the

X Additional Chief Metropolitan Magistrate, Bengaluru, are hereby quashed in terms of the aforesaid joint memo.
