JUSTICE A. GUNESHWAR SHARMA O R D E R 03-12-2025 [1] Present Mr. Tungrei Ngakang, learned counsel for the petitioners; Mrs. R.K. Emily, learned Dy. Government Advocate for the State respondents; and Mr. W. Darakeshwar, learned special counsel for CBI. [2] The petitioners are the victims of deposit scheme floated by Pandam NIDHI Ltd., Ukhrul Branch and pray for transfer of the case to CBI for investigation. The CBI is impleaded as respondent No. 3 in the writ petition. However, the CBI filed an application being MC(WP(C)) No. 534 of 2024 for deleting it from the array of parties on the ground that FIR No. 11(4)2023/UKL-PS U/S 418/422/477/406/403/409/34 IPC has already been registered in this regard and the matter is investigated by the State police. It is also stated that the present matter does not involve any national or international ramification which requires investigation by CBI. Accordingly, it is prayed that CBI be deleted from being a party, i.e. respondent No. 3 in WP(C) No. 80 of 2024 filed by the petitioner. Page 2 of 2 [3] This Court has perused the material on record. It may be noted that when a Division Bench of this Court handed over a case to CBI without impleading CBI, the matter was carried to Hon’ble Supreme Court on the ground that CBI was not impleaded as a party and never heard at the time of transferring the case to CBI. Hon’ble Supreme Court set aside the transfer of the case to CBI and remanded the matter to this Court. CBI having taken a stand on the earlier occasion that transferring the case to it without impleading CBI as party, now, CBI cannot plead that it may be deleted from the array of parties in the writ petition when there is a specific prayer for transfer of the case to CBI. Whether the case is fit to be transferred to CBI or not will be decided in the main writ petition. [4] In the circumstances, MC(WP(C)) No. 534 of 2024 filed by CBI for deleting from the array of parties being respondent No. 3 in WP(C) No. 80 of 2024 is dismissed. [5] No costs. [6] List the remaining matters on 22-01-2026. [7] Pleadings may be completed before the next date.
