This writ petition has been filed with the following prayer: "I. Issue a writ order or direction in the nature of mandamus commanding the respondent no. 3 to give the Fisheries Lease Certificate and Possession of the land of pond Gata No. 250 area 0.802 hectare of Village-Janta, Post-Sonha, Pargana Tappa Umara, Tehsil-Bhanpur, District Basti, U.P. to the petitioner. II. Issue a writ order or direction in the nature of mandamus commanding the respondent no. 2 & 3 to decide the application dated 03.08.2021 of the petitioner within stipulated period fixed by this Hon'ble Court." 2. It is contended that the petitioner had participated in the auction conducted for granting fisheries rights. The bid was conducted on 08.07.2020 and the petitioner being the highest bidder, his bid was accepted and has deposited Rs. 5,000/-. The said bid was approved by the Sub-Divisional Officer on 20.07.2020. According to the petitioner's counsel, the lease deed has not been executed till date. 3. Almost five years have elapsed and no useful purpose would be served in keeping the matter pending and without calling for counter affidavit, this writ petition is disposed requiring the petitioner to move an application ventilating his grievance before the respondent no. 3- Sub-Divisional Officer within a period of 15 days from today. In case, such an application is moved, the same shall be decided by the officer concerned within next one month. 4. With the aforesaid directions, writ petition stands disposed of.
