ORAL ORDER
1. Accused Nos.3 and 4 in Crime No.147/2025 registered by Pandavapura Police Station, Mandya, for the offences punishable under Sections 109, 352, 126(2) and 3(5) of BNS, 2023, are before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.147/2025 was registered by Pandavapura Police Station, Mandya, for the aforesaid offences against Arunkumara and others based on the first information dated 08.06.2025 received from Pramoda P S, who is one of the injured victims in the present case. During the course of investigation, petitioners herein who are arraigned as accused Nos.3 and 4 in the FIR were arrested on 08.06.2025 and remanded to judicial custody. the jurisdictional Sessions Court in Crl.Misc.No.5198/2025 was rejected on 26.06.2025. Therefore, they are before this Court. 4. Perusal of the material on record would go to show that petitioners and the victims in the present case are all known to each other. On the alleged date of incident, accused persons had fought with first informant and had assaulted him. When his friend's son Sharath, who is the other injured victim in the present case tried to interfere, accused had also assaulted Sharath. It is in this background, first informant had approached the police on 08.06.2025. The allegation of assaulting Sharath, with a dragger on his stomach is found as against accused No.1 - Arunkumar. Accused No.3 had allegedly assaulted first informant with the very same dragger in which accused No.1 had assaulted Sharath. Accused No.4 has not assaulted the injured victim with any weapon. The wound certificate of first informant and Sharath, would go to show that first informant has suffered only simple injuries and Sharath has suffered one grievous injury, which corresponds to the assault made by accused No.1. Undisputedly, petitioners herein do not have any criminal antecedents and they are in custody

from 08.06.2025. Under the circumstances, I am of the opinion that their prayer for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:-
5. The petition is allowed.
The petitioners are directed to be enlarged on bail in Crime No.147/2025 registered by Pandavapura Police Station, Mandya, for the offences punishable under Sections 109, 352, 126(2) and 3(5) of BNS, 2023, subject to the following conditions:
a) Petitioners shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons;
c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioners shall not involve in similar offences in future;

e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is
disposed off.
