HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No.24245/2017 1. Chief Manager, Rajasthan State Road Transport Corporation, Ajaymeru Depot, Ajmer. 2. President And Managing Director, Rajasthan State Road Transport Corporation, Head Office, Jaipur. ----Petitioners Versus Union Secretary, Rajasthan State Roadways Employees Union, Ajmer For Workman Shri Yashwant Vyas S/o, Ajaymeru Depot, Ajmer, Rajasthan. ----Respondent For Petitioner(s) : Mr. S.L. Sharma JUSTICE ANOOP KUMAR DHAND Order 03/03/2025 1. By way of filing this writ petition, a challenge has been led to the impugned award dated 29.06.2017 passed by Labour Court- cum-Industrial Tribunal, Ajmer in Case No. SITR 06/2016 by which the punishment order dated 25.02.2015 of the respondent has been quashed and set aside. 2. By passing the impugned order dated 25.02.2015, the respondent-workman was furnished with a penalty of stoppage of two annual grade increments with cumulative effect on the ground that motor accident occurred because of his negligence and the bus of the corporation sustained damages of Rs.1,53,274/- and the aforesaid amount was expanded by the corporation in repairing of the bus. (2 of 2) [CW-24245/2017] 3. The aforesaid order passed by the Disciplinary Authority was assailed by the respondent before the Tribunal. The Tribunal was of the view that the criminal case was lodged against the offending vehicle for the offences under Sections 279 & 337 IPC i.e. against the Driver of the Trolla bearing No. RJ-06-GA-5925 and he was charge-sheeted and, thereafter, he confessed the crime committed by him before the Gram Nayaylaya, Mandal District Bhilwara and on the basis of the same, a fine of Rs.2000/- was imposed on him. 4. The Tribunal while deciding the claim of the respondent was of the opinion that the accident occurred because of the negligence of the Driver of the Trolla and there was no negligence on the part of the respondent-workman. Hence, considering the above factual aspect of the matter, the punishment order dated 25.02.2015 has been quashed by the Tribunal by passing a reasoned and speaking order, which requires no interference of this Court. 5. Accordingly, the writ petition stands dismissed. Stay application as well as all applications (pending, if any) also stand dismissed. (ANOOP KUMAR DHAND),J Karan/10
