Petitioner has been made an accused in connection with ST Case No. 125/2024, arising out of Mihijam P.S. Case No. 45/2024, registered under Section 80 of the BNS, 2023, pending in the court of learned Addl. Sessions Judge-III, Jamtara. The petitioner happens to be the husband of the deceased Naushiya Praveen, who died within seven years of her marriage due to poisoning in her matrimonial home. It is alleged that the deceased was tortured to enforce the demand of dowry. Learned lawyer for the petitioner submitted that the villagers have stated that the accused persons never demand any dowry from the informant. It was further submitted that the petitioner had himself admitted the deceased to the hospital where she succumbed to her injuries. Learned A.P.P. has opposed the prayer for bail and submitted that the dowry is not demanded in full public view and as such the villagers cannot know whether the dowry was demanded or not. Regard being had to the facts and circumstance of the case; I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected. (Ambuj Nath, J.) Saurabh uploaded
