Sundar, CJ] 17.10.2025 [1] Mr. Aribam Gautam Sharma, learned counsel for applicant and Mr. RK Umakanta, learned Deputy GA are before this court. [2] Captioned MC has been filed with a ‘condonation of delay’(CoD prayer qua 1763 days delay in filing criminal appeal by a life convict). [3] Mr. Aribam Gautam Sharma, learned counsel for appellant, adverting to paragraph 6 of the support petition submits that the appellant was languishing in jail without any hope of filing an appeal, inter alia, owing to his financial condition and the matter came to light when the High Court Legal Services Committee took up the matter in the month of September, 2022 and handed over the case to a Pro-Bono Advocate in October, 2022. JOHN TELEN KOM Digitally signed by JOHN TELEN KOM Date: 2025.10.17 16:36:38 +05'30' P a g e 2 | 2 Ultimately, it is submitted that by providence, in April of 2025, an interaction program was organized by the High Court Legal Services Committee, it came to light that the appeal had not yet been filed and thereafter, the appeal has since been filed. [4] Issue notice. [5] Mr. W. Niranjit, learned Deputy Government Advocate accepts notice for State(respondents) and submits that the appellant should have been diligent and should have taken family support. However, we find that the allegations against the appellant is murder of step-mother and he has been ostracized by the family because of the alleged offence is the pleading, this means that the appellant convict did not have family support. In this view of the matter, we overrule the objection of the learned State counsel and deem it appropriate to condone the delay. [6] Captioned MC ordered as prayed for/delay condoned.
