Heard the parties.
The petitioner has been made accused in connection with Barkagaon P.S. Case No. 241 of 2024, corresponding to Special POCSO Case No.82 of 2024, for the offence registered under Sections 64(2) (k)/118/66 of B.N.S. and Section 4 of the POCSO Act, pending in the court of Sri Vishal Kumar, learned Additional Sessions Judge-III-cum-Special Judge, POCSO Act, Hazaribag.
Petitioner is alleged to have raped the deaf and dumb daughter of the informant, who is aged about 17 years old.
Learned counsel for the petitioner has submitted that the statement of the victim has been recorded under Section 183 of the B.N.S., in which, the victim has stated that she was having love with the petitioner and the petitioner had only taken away her ring. It was further submitted that the allegation of sexual assault is not supported by the medical report as the vulva of the victim was found to be intact.
Learned counsel for the informant has opposed the prayer for bail and submitted that the statement of the victim was recorded under Section 183 of the B.N.S by sign language.
Considering the fact that the victim in her statement has not stated about any sexual offence committed by the petitioner, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Vishal Kumar, learned Additional Sessions Judge-III-cum-Special Judge, POCSO Act, Hazaribag, in connection with Barkagaon P.S. Case No. 241 of 2024, corresponding to Special POCSO Case No.82 of 2024.
