BA1 No. 621 of 2025 Hon’ble Alok Mahra, J.
Mr. Siddhant Manral,
learned counsel for the applicant.
Mr. V.S. Pal, learned A.G.A. for the State.
Mr. Suryakant Maithani, learned counsel for the complainant.
2. The applicant – Anand Gupta, who is in judicial custody in connection with FIR/Case Crime No. 0226 of 2024, under Sections 420, 467, 468, 471 and 120-B of IPC, registered at P.S.- Vasant Vihar, District Dehradun, has sought his release on bail.
3. In this case, an FIR was lodged on 15.11.2024 against the applicant and his wife. As per the FIR, applicant has taken Rs. 24 Lakhs from the complainant with the promise that they would provide a skilled work visa for him in U.K. after three months. When the complainant gave money to the applicant and his wife, even after six months, he was not informed regarding any process of his visa. In fact, after three months of giving the money, the visa rejection mail was received by him on the ground that he is already married. Consequently, the present FIR was lodged in which after investigation, chargesheet was filed.
4.
Learned counsel for the applicant would submit that the applicant has falsely been implicated in the case.
5. Learned State Counsel, on the other hand, has vehemently opposed the bail application. He would submit that the trial is underway and the complainant has been
examined as PW1 in the case.
6. Having considered the facts and circumstances of the case, this Court is of the view that prima facie, prosecution has established the involvement of the applicant in the crime and furthermore, the trial is underway and even the complainant has been examined as PW1 in the case. Thus, there is no good ground to enlarge the applicant on bail and the present bail application deserves to be rejected.
7. The present bail application is hereby rejected.
