The present appeal is directed against impugned judgment of conviction and order of sentence dated 17.03.2008 passed by the Additional Sessions Judge, Janjgir, Sessions Division Janjgir- Champa (C.G.) in Sessions Case No.127/06, whereby and 2 whereunder, the appellant stands convicted under Sections 147, 148, 326/149, 325/149, 324/149 and 323/149 of IPC & sentenced him to undergo R.I. for one year, R.I. for one year, R.I. for 03 years with fine of Rs.500/-, R.I. for 02 years with fine of Rs.500/-, R.I. for 01 year with fine fo Rs.500/- and R.I. for 06 months respectively, plus default stipulation. 2. Learned counsel for the appellant submits that during the pendency of appeal, appellant Harishankar died on 29.09.2020 and she has also filed the death certificate of appellant Harishankar to this effect. 3. Learned State counsel has also verified the aforesaid fact and confirmed the death of sole appellant. 4. Thus, in view of the death of sole appellant and in absence of any application for bringing his legal representatives on record to prosecute the appeal, the appeal abates and the same is dismissed as abated. 5.
