Through Power Of Attorney Radheyshyam Dalmia S/o Shri Daburmal Dalmia, Aged About 91 Years, Resident Of Ward No. 15, Pilani, District Jhunjhunu, Rajasthan. ----Petitioner Versus 1. The State of Rajasthan, through its Secretary, Department of Local Bodies, Jaipur. 2. Superintending Engineer, Public Works Department, National Highway No. 709, Section, Churu Rajasthan. 3. Sub-Divisional Officer, Tehsil Surajgarh, District Jhunjhunu. ----Respondents For Petitioner(s) : Ms.Chhaya Sharma & Mr.Ankit Kumar on behalf of Mr.Tapeshwar Singh Parmar JUSTICE ANOOP KUMAR DHAND Order 11/07/2025 1. Learned counsel for the petitioner submits that without acquiring the land of the petitioner, certain constructions has been done over her land which is causing inconvenience to the petitioner, hence, the petitioner approached the Sub-Divisional Officer (for short, “the SDO”), by way of filing an application for redressal of her grievances. 2. Counsel submits that the SDO referred the matter to the Superintending Engineer, PWD to look into the matter, inquire [2025:RJ-JP:25614] (2 of 2) [CW-16614/2024] about the facts and pass appropriate orders. Counsel submits that the aforesaid direction was issued to the Superintending Engineer, PWD way back in the month of February, 2024, but in spite of passing of considerable time, till date, the application/ representation submitted by the petitioner has not been decided by the Authorities concerned by passing a reasoned and speaking order, hence, interference of this Court is warranted. 3. Considering the above submissions made by counsel for the petitioner and looking to the fact that the matter has been referred to the Superintending Engineer, PWD, it is expected from the Authorities concerned to decide the application/ representation submitted by the petitioner (pending, if any), strictly in accordance with law, by passing a reasoned and speaking order, expeditiously as early as possible, not beyond the period of three months from the date of receipt of certified copy of the order. 4. Before parting with the order, it is made clear that this Court has not issued any direction/ order to the respondents to decide the application/ representation of the petitioner in a particular way. They would be at liberty to decide the same strictly in accordance with law. 5. Accordingly, the instant writ petition stands disposed of. Stay application and all pending application(s), if any also stand disposed of. (ANOOP KUMAR DHAND),J Aayush Sharma /6
