SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Ritesh Kumar, Advocate For the State : Ms. Ruby Pandey, APP ----- 03/01.07.2025: This is an application filed by the petitioner praying for grant of anticipatory bail in terms of sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023, as the petitioner has been allegedly implicated in connection with Palkot PS Case No. 54 of 2024, for the offences punishable under sections 17(b)/21(b)/22(b)/29 of the Narcotics Drugs & Psychotropic Substance Act, 1985, pending in the Court of learned Sessions Judge, Gumla. 2. Heard the learned counsel for the petitioner and the learned counsel for the State. 3. The learned counsel for the State opposes the prayer for anticipatory bail of the petitioner. 4. The allegation in the FIR is that the son of this petitioner was driving a vehicle which is registered in the name of this petitioner and from the pocket of the son of this petitioner 2.160 gram of Brown Sugar was recovered. 5. After hearing the parties I find that the vehicle bearing registration no. JH01ER-7515 is registered in the name of this petitioner and admittedly the son of this petitioner was driving the said vehicle and contraband material was recovered from the pocket of the son of this petitioner. This petitioner was neither driving the vehicle nor there is any material to suggest that he was instrumental in supply of this material. The quantity of the material is also not commercial that too was not recovered from the possession of this petitioner. 9. Considering the aforesaid fact, I am inclined to allow this anticipatory bail application of this petitioner. 10. Accordingly, the petitioner, above named, is directed to surrender before the court below within three weeks from today and in the event of his

10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Gumla, in connection with Palkot PS Case No. 54 of 2024, subject to the condition that one of the bailers should be close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the learned trial court indicating his/her share in the property.
