The petitioner is the unmarried daughter of Jagannath Bera who was a Panchayat Karmee at Haripur Gram Panchayat. The petitioner’s father superannuated on 31st December, 2021 and expired on 31st April, 2002. After his demise, his wife Santabala Bera received family pension till she expired on 11th February, 2022. The petitioner submits that though she is the unmarried daughter of the said employee and is entitled to family pension in terms of the memo issued by the West Bengal, Finance Department (Pension Branch) on 12th November, 2008, such pension has not been considered by the authority. Learned counsel for the petitioner submits that no application has been made by the petitioner seeking such family pension though the petitioner has obtained legal heir certificate and income certificate from the appropriate authorities. In view of the above, the petitioner is granted liberty to submit a comprehensive application seeking family 2 pension before the District Panchayat and Rural Development Officer, Midnapore, being the 4th respondent herein alongwith relevant documents within three weeks from date. The 4th respondent is directed to consider and dispose of the same within eight weeks from the date of receipt thereof upon granting reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
