G.P. for Services-II The Court made the following: 2 WP(AT).No.1414 of 2021 ORDER: The writ petition is filed under Article 226 of Constitution of India seeking the following relief: “…to declare the action of the respondents in not regularizing the services of the applicant from the date on which he has completed 5 years of continuous service or at least from the cutoff date stipulated in G.O.Ms.No.212 dated 22.04.1994, i.e., 25.11.1993 at appropriate time and regularizing the services of their counterparts vide G.O.Ms.No.11, Finance (HR.III) Department, dated.20.01.2017 by taking their own time of 23 years to implement the orders G.O.Ms.No.212 dated 22.04.1994 and thereby depriving such a benefit of regularization of services of the applicant as arbitrary, illegal, unjust, discriminatory and violative of Article 14, 16 and 21 of the Constitution of India and consequently hold that the applicant is entitled to be regularized his services soon after completion of five years of his service as daily wage/full time contingent employee or at least w.e.f. 25.11.1993 with all consequential benefits, such as, pay fixation, old pension scheme, revised pay scales etc., in the light of the law laid down by the Hon'ble Apex Court in the case of B.Srinivasulu vs. The Nellore Municipal Corporation represented by Commissioner in Civil Appeal No.6318 of 2015, dated 17.08.2015, followed by this High Court in W.P.No.5402 of 2017, dated 09.06.2017 and the Orders of Tribunal in O.A.No.2179 of 2007, dated 18.01.2010 and to pass…” 3 WP(AT).No.1414 of 2021 02. The learned counsel for the petitioner appearing through video conference submitted that in view of G.O.Ms.No.60, Agriculture and Cooperation (H & S) Department, dated 08.10.2021, no order is now required in this writ petition and thus, the relief sought has become infructuous. 03. Ms.C.Indrani, learned Assistant Government Pleader for Services-II is present. 04. Accordingly, recording the above submission, the writ petition is dismissed as infructuous. There shall be no order as to costs. Interim orders granted earlier, if any, shall stand vacated.
