CMP No.23973 of 2025 The present application is being made filed seeking permission to use the playground of the school for conducting the Panchayat Level Volleyball competition on 01.10.2025 after school time from 4:00 pm, on 02.10.2025 from 7:00 am to 10:00 pm and for cultural activities on 02.10.2025 from 7:00 pm to 10:00 pm on the occasion of Gandhi Jayanti on 02.10.2025. The said application is being filed by the Nav Yuvak Mandal Sudha, Tehsil Chirgaon, District Shimla.
2. Learned counsel for the State has placed on record communication dated 24.09.2025 received from the Principal, Govt. Senior Secondary School, Chirgaon, stating that permission has to be taken from this Court.
3. In view of the fact that school will remain closed on 02.10.2025 and the Volleyball competition is to be held after school timing, i.e. after 4:00 pm, and further taking note of the fact that on earlier occasion, permission was granted in the year 2021 in CMP No.1766 of 2021 and
similar permission was also granted in CMP No.18182 of 2024 on 30.09.2024, while noting the reasons recorded in CMP No.1766 of 2021, we allow the present application with the following directions:- i) That the playground shall not be damaged and any garbage that is created [Sic generated] during the function, be got cleared by the concerned authorities; ii) That no loss shall be caused to the property of the school and also the ground, where the function is proposed to be organized; iii) That the order passed in CWPIL No.146 of 2017 shall be complied with strictly; iv) That the school premises shall be kept neat and clean and no disturbance [Sic would be] caused to the academic atmosphere of the school, and v) That the law and order shall be maintained by the administration during the said period. vi) Sum of Rs.20,000/- be deposited with the School Welfare Fund for the usage of the premises.
4. The applicant will adhere to the aforesaid conditions. The application stands disposed in the aforesaid terms. (G.S. Sandhawalia) Chief Judge
