HRTC vs. Priyanka Devi & others FAO No.298 of 2018 18.08.2025 Present: Mr. Vikas Rajput, Advocate, for the appellant. Mr. Uday Singh Banyal, Advocate, for the respondents. CMP No.17900 of 2025 The applicants seek, by way of this application, discharge of their Guardian, who had been representing the applicants during the period of their minority in FAO No.298 of
2018. It is averred that all the applicants i.e. respondents No.1 to 3 in FAO No.298 of 2018, namely, Ms. Priyanka Devi, Ms. Riya and Ms. Deha have now attained majority. In support of the averments made in the application besides, the affidavit of applicant Priyanka Devi, the affidavit of mother of the applicants has been filed. Further, copies of the matriculation examination certificates of the applicants have also been placed on record, according to which, the date of birth of applicant/respondent No.1 Priyaka Devi is 31.03.2003, Ms. Riya @ Isha Sharma is 13.11.2004 and applicant/respondent No.3 Ms. Deha @ Diya Sharma is
15.02.2006. The
discrepancy
in
the
names
of applicants/respondent No.2 and 3, namely, Ms. Riya and Ms.Deha has been clarified by their mother Ms. Anita Devi by way of an affidavit filed by her. It is stated in the affidavit that at
the time of filing of claim petition, the name of applicant/respondent No.2 was recorded as Riya, which was her nick name, whereas in the school record, her name was recorded as Isha Sharma. Similarly, in the case of applicant/respondent No.3, her name was recorded as Deha (nick name) while drafting the claim petition, whereas the name of said applicant, as per school record is Diya Sharma. Since, the aforesaid facts have been sworn by none other than the mother of the applicants/respondents No.2 and 3 and there is nothing on record to disbelieve her version, the facts so stated are taken to be correct. Accordingly, it is found that all the applicants/respondents No.1 to 3, namely, Ms. Priyanka Devi, Ms. Riya @ Isha Sharma and Ms. Deha @ Diya Sharma having attained majority are entitled to proceed with the matter in their own right and their Guardian stands discharged. Accordingly, the application stands disposed of. CMP No.17903 of 2025 By way of this application, a prayer has been made by applicants/respondents No.1 to 3, 5 and 7 for release of award amount lying to their respective shares.
Applicants/respondents No.1 to 3 are of young age and there is no specific reason as to why they require the entire award amount, at this stage. Hence, the prayer qua applicants/respondents No.1 to 3 is rejected at this stage. However, they shall be at liberty to make fresh applications with specific reasons for release of award amount. The application insofar as relates to prayers made by applicants No.5 and 7, namely, Ms. Anita Devi and Vidhya Devi is concerned, is allowed. Registry is directed to release the award amount lying in respective shares of applicants/respondents No.5 and 7, namely, Ms. Anita Devi and Ms.Vidhya Devi along with up-to-date interest accrued thereon till date by remitting the same directly to the bank accounts of the said applicants, as detailed in para 5(d) and 5(e) of the application, after due verification. Accordingly, the application stands disposed of. ( Satyen Vaidya )
