Mr. Pushpinder Jaswal, Additional Advocate General, for the non-applicant/respondent.
Learned Additional Advocate General submits that the State has preferred a Letters Patent Appeal against the judgment in Inder Singh Thakur’s case, in light whereof, the matter of the present petitioners was dismissed.
Learned counsel for the petitioners submits that there is no stay granted in the Letters Patent Appeal by the Hon’ble Division Bench against the judgment of the Hon’ble Single Judge and in similar cases, the State is implementing the order and the petitioners is being discriminated. He has handed over the orders passed by the authorities to the learned Additional Advocate General to support his contention.
Learned Additional Advocate General submits that he may be granted some time to have instructions in this regard.
List on 09.12.2025, as prayed for. In the meanwhile, it is observed that if despite the pendency of
the Letters Patent Appeal, the benefit of the judgment already stands conferred upon persons similarly situated as the petitioners, then, needful be done in the case of the petitioners also subject to the outcome of the Letters Patent Appeal.
