The petitioner has been made accused in connection with S.T. Case No.257 of 2024 arising out of Balumath P.S Case No.182 of 2019, corresponding to G.R. Case No.648 of 2019, for the offence registered under Sections 25 (1-B) (a), 25 (1- A), 26 (2), 35 of the Arms Act and Section 17 of the CLA Act., pending in the Court of learned Additional Sessions Judge-II, Latehar. On 30.08.2019, Officer In-charge of Balumath Police Station on the basis of confidential information that extremists belonging to T.S.P.C Organization had gathered in Balumath forest raided the place of occurrence. Police arrested co- accused Jivlal Ganjhu and from his possession, firearm and naxal pamphlets were recovered. Name of the petitioner has transpired in confession of co-accused Jivlal Ganjhu. Learned counsel for the petitioner submitted that petitioner was neither apprehended at the spot nor anything was recovered from his possession. It was further submitted that similarly situated several co-accused persons have been granted by this Court as well as by Co-ordinate Bench of this Court. It was finally submitted that co-accused Jivlal Ganjhu has been granted bail by Co-ordinate Bench of this Court. Learned A.P.P. has opposed the prayer for bail and submitted that petitioner has got criminal antecedent. Considering the fact that there is no cogent material against the petitioner on the record, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II, Latehar, in connection with S.T.
