The petitioner herein is aggrieved by the order passed by the learned Trial Court, dated 20.12.2024, in terms whereof, the defence of the defendant was closed. 3. Having heard learned Legal Aid Counsel for the petitioner, though this Court is of the considered view that sufficient indulgence was shown to the petitioner by the learned Trial Court for the purpose of filing of the written statement, yet taking into consideration the fact that if the defendant is not allowed to file written statement, she shall not in a position to put-forth her 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:35063 defence before the learned Trial Court, this Court is showing indulgence by setting aside order dated 20.12.2024 by providing one opportunity to the petitioner herein to lead evidence subject to payment of cost of Rs.10,000/- by the petitioner to the respondent. The petitioner shall put in appearance before the next date that has been fixed by the learned Trial Court and apprise the learned Trial Court of the order passed by this Court. On the said date, in case the cost that is ordered by this Court is paid by the petitioner to the respondent, that is to say to the plaintiff, then the learned Trial Court shall give one opportunity to the petitioner to file written statement. In case, the cost is not paid on the said date by the petitioner to the plaintiff, then this order will loose its efficacy and order dated 20.12.2024 shall again become operative. 4.
