Heard the parties.
The petitioners have been made accused in connection with Chirkunda P.S. Case No. 41 of 2023, for the offences registered under Sections 147, 148, 149, 307, 354, 395, 436, 427, 452 and 120-B of the Indian Penal Code, pending in the court of Sri S.K.Singh No.III, learned Chief Judicial Magistrate, Dhanbad.
On 31.01.2023 at about 08:00 am, the petitioners alongwith about 250 persons went to the village Balubankar, Chirkunda and assaulted the villagers. It is alleged that the mob looted jewelries and other valuables from there.
Learned counsel for the petitioners has submitted that there is case and counter case between the parties. It was further submitted that prior to the occurrence, villagers had assaulted one Deepak Bauri due to which he sustained grievous injury and subsequently succumbed to it.
It was also submitted that the entire occurrence has taken place due to repercussion after the death of Deepak Bauri. It appears that several co-accused persons have been granted regular bail by the Coordinate Bench of this Court as well as several co-accused persons have been granted anticipatory bail by this Court. It further appears that there is general and omnibus allegation against the petitioners.
Learned Spl.P.P on behalf of the State has opposed the prayer for bail.
In view of the aforesaid fact, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of Sri S.K.Singh No.III, learned Chief Judicial Magistrate, Dhanbad, in connection with Chirkunda P.S. Case No. 41 of 2023.
