VENKATESH FOR THE ALLEGED OFFENCE U/S. 78, 85, 115(2), 118(1) OF THE BNS, 2023 AND SEC.75 OF JUNVENILE JUSTICE (CARE AND PROTECTION OF CHILDREN) ACT 2015 REGISTERED BY THE RESPONDENT NO.1 (VIDE ANNEXURE-A) SO FAR AS THE PETITIONERS IS CONCERNED. THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner has sought for the following relief:- “a) Quash the entire proceedings lodged by the respondent police in Crime No.169/2025 lodged by one Hansika D/o Venkatesh for the alleged offences punishable under Sections 78, 85, 115(2), 118(1) of the Bharatiya Nyaya Sanhita (BNS) 2023 and Section 75 of Juvenile Justice (Care and Protection of Children) Act 2015 registered by the Respondent No.1 (Vide Annexure-A) so far as the petitioners is concerned and - 3 - HC-KAR NC: 2025:KHC:24843 CRL.P No. 9451 of 2025 b) Issue any other order or directions and such other reliefs as this Hon’ble Court deems fit to grant in the facts and circumstances of the case in the interest of justice.” 2. Learned counsel for the petitioner – accused and learned counsel for 2nd and 3rd respondents – complainants have filed a Joint Memo duly signed by the petitioner, 2nd and 3rd respondents and their respective counsel and the same is taken on record. 3. Petitioner – accused, respondent Nos.2 and 3 and their counsel are physically present before the Court and they admit the contents of the Joint Memo, which reads as under:- “JOINT MEMO The undersigned counsel for the petitioner and respondent respectfully submit that the Respondent No.2 is the wife of petitioner and Respondent No.3 is daughter of petitioner. It is further submitted that, both the parties have mutually agreed to compromise the offence alleged U/s 78,85,115(2).118(1) of the Bhartiya Nayaya Sanhita (BNS)2023 and sec 75 of Juvenile justice (care and protection of children) Act 2015 in Crime No.0169/2025. - 4 - HC-KAR NC: 2025:KHC:24843 CRL.P No. 9451 of 2025 It is further submitted that the respondent No.2 and 3 without any condition of their own and came Forword to compound the offence alleged against the petitioner. Consequently Respondent No.2 and 3 is consenting for quashing of proceedings pending Crime No.0169/2025 lodged by one Hansika D/o Venkatesh for the alleged offences U/s 78,85,115(2).118(1) of the Bhartiya Nayaya Sanhita (BNS)2023 and sec 75 of Juvenile justice (care and protection of children) Act 2015 registered by the Respondent No.1 and petitioner do hereby undertake to take care of respondent No.2 and 3. Wherefore the petitioner and respondent No.2 and 3 prays this Hon'ble court to kindly take the above joint memo into record to serve the interest of justice.” 4. In view of the aforesaid settlement entered into between the petitioner and 2nd and 3rd respondents, I pass the following: ORDER (i) The petition is disposed of in terms of Joint Memo dated 08.07.2025. (ii) The Complaint / FIR in Crime No.169/2025 dated 19.05.2025 of Kodigehalli Police Station registered for the offences punishable under - 5 - HC-KAR NC: 2025:KHC:24843 CRL.P No. 9451 of 2025 Sections 78, 85, 115(2), 118(1) of BNS and Section 75 of Juvenile Justice (Care and protection of children) Act, 2015, in relation to the petitioner, are hereby quashed.
