JUSTICE SUDESH BANSAL Order 01/07/2025 1. Petitioner is claiming grant of appointment on the post of ANM under Physically Disabled Category pursuant to the advertisement dated 06.07.2023. 2. Perusal of previous order sheets dated 23.10.2024 and 08.01.2025 shows that no one appeared on behalf of petitioner to pursue the writ petition and on the previous occasion i.e. on 24.04.2025, when the matter was listed, counsel for the petitioner prayed for an adjournment. Petitioner was granted last opportunity to argue the matter on merits but today as well, no [2025:RJ-JP:24040] (2 of 2) [CW-15102/2024] one has appeared on behalf of petitioner to pursue the writ petition on merits. 3. In such circumstances, the case of petitioner is being considered on merits as per the material available on record. 4. It is admitted case of petitioner that she applied for the post in question under Physically Disabled Category. As per the advertisement, 4% reservation to the Physically Disabled Persons is available and in the LD/CP Category, the person suffering from disability in one leg is eligible for such reservation. 5. As per the disability certificate dated 04.01.2018 (Ann.3) of the petitioner, the petitioner is suffering from physical impairment of left hand. Such nature of physical disability is not indicated in the advertisement. Although, the name of petitioner was short listed in the provisional list but after document verification, she was found ineligible to consider her candidature under disabled category, hence, she was not selected in the final merit list. 6. Thus, this Court finds that since the physical impairment of one hand, from which the petitioner is suffering, is not included in the advertisement considering the nature of post of ANM. The person suffering from physical impairment of one leg is included. 7. Hence, the claim of petitioner for seeking appointment under Physically Disabled Category for the post of ANM is misconceived and the writ petition is hereby dismissed. 8.
