The writ petition has been filed for the following relief: "Issue a writ order or direction in the nature of mandamus commanding and direction to the respondent No. 3 Tahsildar Tehsil Belthara Road, Ballia to decide the restoration application dated 19/02/2024 filed by respondent No. 4 in Case No. T202215090702480 State vs. Swahanand, under section 67 of U.P. Revenue Code 2006 Mauza Indauli Malkauli, Paragana Sikandarpur Garvi Tehsil Belthara Raod District Ballia and further directing the respondent No. 3 to remove the illegal encroachment made by the respondent No. 4 over the Gaon Sabha Land i.e. Arazi No. 326. Mauza Indauli Malkauli Tehsil Belthara Road, District Ballia which is recorded in the name of Primary School." 3. Learned Standing Counsel raised a preliminary objection that the petitioner is the complainant and is not party to the aforesaid proceedings, therefore, the proceedings cannot be expedited at his behest. 4. However, this Court has no information as to pendency of the cases of similar nature before the court concerned, therefore, no direction can be given to expedite the case. 5. In view of the above, I am not inclined to interfere in the matter. 6. Since the restoration application is pending, it is expected that the same shall be decided in accordance with law after giving opportunity of hearing to all the concerned parties. 7.
